These Terms of Service ("Terms") govern your use of the SilentAPI service (the "Service"). By creating an account or using the Service in any way, you agree to these Terms in full. If you disagree with these Terms or any part of these Terms, you must not use the Service.

1. Beta Service Acknowledgment

You acknowledge that the Service is provided in a "beta" phase. This means the Service is provided "AS IS" and may contain bugs, errors, and other issues. You accept that:

• We provide no uptime or reliability guarantee. The live status record is on the [ Status ] page.
• We may add, modify, or remove APIs and other features at any time, without notice or warning.
• We may change our pricing at any time, without notice or warning.
• The Service may be discontinued or shut down permanently at any time without notice.

Your use of the beta Service is entirely at your own risk.

2. Accounts and Access

You are responsible for safeguarding your API key and any other credentials used to access the Service. You agree to accept full responsibility for all activities that occur under your account.

3. User Responsibility and Assumption of Risk

You agree that SilentAPI is provided as a neutral tool. You are solely and exclusively responsible for all actions, content, and activities conducted through your account. We are not responsible for how you use the Service, the purposes for which you use it, or the legality of your actions in any jurisdiction. You agree to assume all risks associated with your use of the Service, and you agree that you cannot hold us liable if your use of our service results in legal, financial, or other repercussions for you.

4. Service Provision

SilentAPI runs some services itself, such as media tools, OCR and lookups. Other services use a model or service provider. The [ Services ] page shows the privacy label of each model. We do not keep your prompts or outputs for normal API calls. Optional usage and billing records hold counts and credits per service per hour. The [ Privacy Policy ] explains these records, lookup caches, and provider privacy labels.

5. Prohibited Illegal Conduct

You must not use the Service for illegal activity. You must not use it to generate, host, or distribute the following content:

• Child Sexual Abuse Material (CSAM): Any content depicting sexual exploitation of minors.
• Terrorism and Violent Extremism: Content that promotes, plans, or incites acts of terrorism or violent extremism.
• Scams and Fraud: Any use of the Service to engage in fraudulent activities, financial scams, phishing, identity theft, or deceptive practices.
• Network Attacks: Any form of Denial-of-Service (DoS) attack, unauthorized system intrusion, or malware distribution.

We can close an account if valid legal process or clear evidence shows this activity. We cooperate with the relevant authorities as required by law.

6. Payments, Refunds, and Forfeiture

Payments through NowPayments and Cryptomus use cryptocurrency to buy prepaid credits. We review refunds case by case. We may offer a partial refund. We deduct the fees we paid from any refund. If we close your account for a breach of these Terms, as described in Section 7, you forfeit any remaining balance.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason or for no reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease, and any data or funds associated with the account may be deleted or forfeited.

8. Disclaimer of All Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Absolute Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SILENTAPI, ITS OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE, INCLUDING ANY SERVICE INTERRUPTIONS OR DOWNTIME; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, INCLUDING BUT NOT LIMITED TO SECURITY BREACHES, EXPLOITS, OR DATA LEAKS. YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK.

10. Indemnification

You agree to defend, indemnify, and hold harmless SilentAPI and its operators from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service or any breach by you of these Terms. This indemnification obligation includes any legal trouble, lawsuits, or claims brought against SilentAPI as a result of your activities or the content you generate.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time without notice. It is your sole responsibility to review these Terms periodically for changes. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

12. Dispute Resolution

You agree that any and all disputes, claims, or controversies arising out of or relating to these Terms shall be directed to our support team via our official contact page. By using the Service, you waive any right to participate in any form of litigation, arbitration, or class action against SilentAPI. 13. Third-Party Terms of Service

You must follow the terms of each API you use through SilentAPI.

• Anthropic: Commercial Terms of Service; Usage Policy.

Other providers have their own terms. You must follow the terms of the provider that serves your request.

14. Privacy Policy Acknowledgment

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to the [ Privacy Policy ]. Your agreement to these Terms includes your acknowledgment and acceptance of that Privacy Policy.
