These Terms of Service ("Terms") govern your use of the SilentAPI service (the "Service"). By creating an account or using the Service in any way, you agree to these Terms in full. If you disagree with these Terms or any part of these Terms, you must not use the Service.
1. Beta Service Acknowledgment
You acknowledge that the Service is provided in a "beta" phase. This means the Service is provided "AS IS" and may contain bugs, errors, and other issues. You accept that:
- We provide no uptime or reliability guarantees. However, historically we have maintained 99.95+% uptime for our APIs.
- We may add, modify, or remove APIs and other features at any time, without notice or warning.
- We may change our pricing at any time, without notice or warning.
- We may delete your account, your data, and any funds associated with it at any time, for any reason, without notice or warning.
- The Service may be discontinued or shut down permanently at any time without notice.
Your use of the beta Service is entirely at your own risk.
2. Accounts and Access
You are responsible for safeguarding your API key and any other credentials used to access the Service. You agree to accept full responsibility for all activities that occur under your account.
3. User Responsibility and Assumption of Risk
You agree that SilentAPI is provided as a neutral tool. You are solely and exclusively responsible for all actions, content, and activities conducted through your account. We are not responsible for how you use the Service, the purposes for which you use it, or the legality of your actions in any jurisdiction. You agree to assume all risks associated with your use of the Service, and you agree that you cannot hold us liable if your use of our service results in legal, financial, or other repercussions for you.
4. Service Provision
Our Service provides unified access to a variety of third-party and proprietary APIs. Some APIs are provided by our partners, while others are operated by us. In all cases, we are committed to a strict no-logs and privacy-focused policy. We do not monitor specific user behavior, especially for users who opt-out of metrics tracking.
5. Prohibited Illegal Conduct
While SilentAPI maintains a strict policy of non-moderation and user privacy, we act as a common carrier and do not condone illegal activity. You agree that you will not use the Service for any purpose that is unlawful or prohibited by these Terms. Specifically, you are strictly prohibited from using the Service to generate, host, or distribute:
- Child Sexual Abuse Material (CSAM): Any content depicting sexual exploitation of minors.
- Terrorism and Violent Extremism: Content that promotes, plans, or incites acts of terrorism or violent extremism.
- Scams and Fraud: Any use of the Service to engage in fraudulent activities, financial scams, phishing, identity theft, or deceptive practices.
- Network Attacks: Any form of Denial-of-Service (DoS) attack, unauthorized system intrusion, or malware distribution.
Although we do not proactively monitor for this content, if we are made aware of such activity through valid legal process or undeniable evidence, we reserve the right to immediately terminate the account and cooperate with relevant authorities as required by law.
6. Payments, Refunds, and Forfeiture
All payments are made via cryptocurrency to a prepaid balance. All payments are final and non-refundable. In exceptional cases, we may, at our sole discretion, agree to a refund request. Any such approved refund will be subject to a 30% processing fee plus any applicable network transaction fees. This policy is in place to prevent the use of our service for short-term fund storage. You acknowledge and agree that we reserve the absolute right to remove funds from your account, block your account, or delete your account without warning or liability.
7. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason or for no reason, including but not limited to a breach of these Terms.
8. Disclaimer of All Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Absolute Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SILENTAPI, ITS OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE, INCLUDING ANY SERVICE INTERRUPTIONS OR DOWNTIME; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, INCLUDING BUT NOT LIMITED TO SECURITY BREACHES, EXPLOITS, OR DATA LEAKS. YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK.
10. Indemnification
You agree to defend, indemnify, and hold harmless SilentAPI and its operators from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service or any breach by you of these Terms. This indemnification obligation includes any legal trouble, lawsuits, or claims brought against SilentAPI as a result of your activities or the content you generate.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time without notice. It is your sole responsibility to review these Terms periodically for changes. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
12. Dispute Resolution
You agree that any and all disputes, claims, or controversies arising out of or relating to these Terms shall be directed to our support team via our official contact page. By using the Service, you waive any right to participate in any form of litigation, arbitration, or class action against SilentAPI. 13. Unfiltered AI Models and Content Liability
SilentAPI acts exclusively as a passive conduit for the transmission of data. We host and provide access to "unfiltered" artificial intelligence models which function without safety filters, moderation guardrails, or ethical inhibitors. By using our hosted AI services, you explicitly acknowledge and agree to the following:
- No Moderation: We do not monitor, moderate, scan, view, or filter any input provided by you or any output generated by the models. The models are provided "raw" and "uncensored."
- Sole Responsibility: You assume sole and exclusive responsibility for all content generated through your account. You acknowledge that the lack of filters means models may generate content that is offensive, disturbing, sexually explicit, harmful, or factually incorrect.
- Lawful Use Only: While the models are unfiltered, they are not a license to commit crimes. You agree that you are solely liable for ensuring that your use of these models complies with all applicable laws in your jurisdiction. SilentAPI assumes no liability for any illegal, infringing, or harmful content you may generate.
- Waiver of Claims: You hereby release and forever discharge SilentAPI and its operators from any and all liability, claims, or damages arising from the nature of the content generated by these unfiltered models, including but not limited to claims of psychological distress, defamation, or exposure to offensive material.
14. Third-Party Terms of Service
